Trademarks, logos, and content
Trademarks, logos and other distinctive signs appearing on the site belong to their respective owners. The use of such trademarks, logos and other distinctive signs—including reproduction on other websites—by unauthorized third parties is prohibited. The contents of the site (texts, graphics, images and animations) are protected by copyright; therefore, reproducing images and publishing them in any form without the prior written authorization of FANATICS ITALY is prohibited.
The following terms apply to every purchase made through the Site.
Art. 1 – DEFINITIONS
1.1. “Site”: the website laziostylestore.com, dedicated to the sale of the official merchandising of S.S. Lazio S.p.A.
1.2. “Customer”: the party (natural or legal person) who makes a purchase on the Site, accepting these general terms of sale.
1.3. “FANATICS ITALY”: FANATICS ITALY S.R.L., Via Magistretti 10, 20128 Milan, registered with the Milan Chamber of Commerce no. 359848 – Tax/VAT no. 11670080156. FANATICS ITALY is the official licensee of S.S. Lazio S.p.A.
1.4. “Order”: the request form for goods on sale, completed by the Customer via the Site.
1.5. “Products”: the goods offered for sale on the Site under these general terms of sale.
1.6. “Customized Products”: goods customized at the Customer’s specific request/instructions.
1.7. “Price”: the consideration due for the goods.
1.8. “Contract”: the distance contract for the sale of Products under these general terms of sale.
1.9. “Parties”: FANATICS ITALY and the Customer.
Art. 2 – TECHNICAL PROCEDURE FOR CONCLUSION OF THE CONTRACT
2.1. Products are offered for sale under the terms and conditions set out in the Contract published on the Site at the time of the Order.
2.2. To make a purchase, the Customer must:
I) select the product and click “add to cart”: a summary of the main features of the selected product and the total price due will appear, including shipping costs (excluding only any customs duties, where due) and taxes;
II) click “proceed to checkout” and complete the Order, indicating the chosen payment method (and any preferred shipping method, where applicable); before proceeding, the Customer must verify the accuracy of the data provided and is responsible for their truthfulness;
III) read these general terms and accept them by ticking the box next to “I accept the terms and conditions of sale”;
IV) click “purchase/CONFIRM AND PAY”: as required by law, the button shows that placing the Order entails an obligation to pay for the goods.
2.3. The Customer will then receive an Order confirmation indicating the type of products ordered, the price of each, delivery charges, the chosen payment method, and notice of the right of withdrawal under Art. 8 below, which may be exercised where the relevant conditions are met.
2.4. The Contract is deemed concluded and binding when FANATICS ITALY sends the Order confirmation to the Customer’s email address.
2.5. The Contract will be archived; the Customer may view it by accessing their personal area or by contacting Customer Care.
2.6. The creation and supply of Customized Products offered for sale on the Site is subject to a specific request by the Customer, to be made in accordance with the instructions on the Site. For such Products, advance payment is required and the right of withdrawal from the purchase Contract is excluded.
2.7. In addition to Italian, the Contract may be concluded in English.
Art. 3 – DELIVERY TIMES AND METHODS
3.1. Delivery of the products to the shipping address indicated by the Customer in the Order is carried out by express courier.
3.2. Indicative delivery times: 24–48 hours for Italy, 48–72 hours for Europe, 3 or more working days for non-European countries, after 24 hours from the date FANATICS ITALY receives the Order. The times are indicative and not strictly binding on FANATICS ITALY. In any case, delivery will take place no later than 30 days from the date of conclusion of the Contract.
3.3. If delivery of the goods does not occur within the agreed term or within 30 days, the Customer must invite FANATICS ITALY to deliver within a reasonable additional period; the Customer may terminate the Contract only if that additional period expires without delivery. No additional period is required where:
a) FANATICS ITALY has expressly refused to deliver the products; or
b) the agreed delivery term must be considered essential, taking into account the circumstances surrounding conclusion of the Contract; or
c) the Customer informed FANATICS ITALY, before conclusion of the Contract, that delivery by/on a specific date is essential.
In such cases, if the Customer does not receive the products within the agreed term, the Customer is entitled to terminate immediately, without prejudice to damages, and FANATICS ITALY must refund without undue delay all amounts paid in performance of the Contract.
3.4. In the event of unavailability of one or more products arising after the Order confirmation, FANATICS ITALY will notify the Customer by email. The Order may be cancelled in full with a full refund (without undue delay) orpartially accepted limited to available products; in such case the Customer will pay (and be charged) only the price relating to the products available.
**3.5. By placing an Order, the Customer represents that the products ordered are lawful to possess and use in the place of destination and that they will be possessed or used only lawfully, in compliance with all applicable laws (including copyright laws); the Customer also represents they are entitled to use the chosen payment method. Ordering for the purpose of resale is prohibited: purchases are for personal, non-commercial use.
Art. 4 – REGISTRATION
4.1. No prior registration is required to purchase. The user may choose to register (free of charge, quickly, and without any purchase obligation). On placing the first Order, the Customer will be automatically registered and will receive a generic password, which can be changed immediately via the link in the confirmation email. The Customer undertakes to provide correct, truthful and complete data (personal details, contact details, and other information useful for fulfillment).
4.2. The Customer must keep a copy of the purchase confirmation sent by laziostylestore.com to the email address provided during registration.
Art. 5 – PRICE, PAYMENT AND INVOICING
5.1. Prices are expressed in Euro (€) and include the VAT applicable to the relevant product categories.
5.2. The total price shown at the end of the Order includes shipping costs, but excludes any customs duties and/or additional sales taxes required for import into a foreign country. Any additional customs-clearance charges are borne exclusively by the recipient.
5.3. Payment may be made:
– at the time of the Order, for advance payment by credit card or PayPal;
– upon delivery of the products, for Cash on Delivery. This is cash only and only for orders delivered in Italy.
5.4. Any invoice request must be made at the time of the Order by ticking the relevant box at checkout.
Note: where payment is by Cash on Delivery, an Invoice will not be issued.
Scalapay: you receive your order immediately and pay in 3 installments. You acknowledge that the installments will be assigned to Incremento SPV S.r.l., to related parties and their assignees, and you authorize such assignment.
5.5. Orders placed by Customers in the United States (DDP / Sales Tax / 5 days)
5.5.1. Products will be shipped on a Delivered Duty Paid (DDP) basis; at checkout an amount may be added to cover estimated import duties into the USA.
5.5.2. To provide DDP service, the Customer agrees that FANATICS ITALY or its subcontractors will act on the Customer’s behalf in relation to the importation of goods, carrying out all customs formalities on behalf of the recipient of the Products.
5.5.3. Information required for customs formalities may be requested; the Customer must respond within 5 days of the request, failing which the Order will be cancelled.
5.5.4.Sales tax, if applicable, will be added to the Order and shown at checkout and in emails sent after the Order (after the goods subtotal).
Art. 6 – FORCE MAJEURE
6.1. If the Contract cannot be performed, in whole or in part, due to unavailability of goods or another cause of force majeure, FANATICS ITALY will notify the Customer by email within thirty days from submission of the Order and will be released from all obligations, except to refund any amounts already paid by the Customer.
Art. 7 – COPYRIGHT AND TRADEMARKS
7.1. The Contract does not grant the Customer any rights over trademarks, logos or other distinctive signs on the site, nor over the related content.
Art. 8 – RIGHT OF WITHDRAWAL (restored in Lazio’s form)
8.1. Pursuant to Articles 52 et seq. of Legislative Decree no. 21/2014, the Consumer Customer has the right to withdraw from the Contract, without penalties and without having to give any reason, within and no later than fourteen (14) days from receipt of the goods (or, in the case of multiple goods ordered with a single order and delivered separately, from the day on which the Customer or a third party designated by the Customer, other than the carrier, acquires physical possession of the last good).
8.2. To exercise the right of withdrawal, before the expiry of the above term the Customer must inform FANATICS ITALY of the decision to withdraw by:
a) sending written notice by post or email (customercare@laziostylestore.com).
8.3. In the event of withdrawal, the Customer must return the goods received to FANATICS ITALY, sending them to FANATICS ITALY S.R.L. – Via Morelli 1, 20054 Segrate (MI) – Italy, without undue delay and in any case within fourteen (14) days from the date on which the decision to withdraw was communicated; the deadline is met if the goods are shipped before expiry of the 14-day period.
8.4. The direct cost of returning the goods is borne by the Customer, including any customs duties. The refund excludes transport costs (both outbound and return) and any customs duties/taxes.
8.5. The Customer must return the goods in good condition and with original labels not removed. Packaging must be careful so as to protect the original wrappers from damage, writing or labels. The Consumer is responsible for any decrease in value of the goods resulting from handling other than that necessary to establish their nature, characteristics and functioning.
8.6. Where the right of withdrawal has been exercised in accordance with the above, FANATICS ITALY will, within thirty (30) days from receipt of the withdrawal notice, refund the Customer all payments received with respect to the order to which the withdrawal relates, using the same means of payment used by the Customer for the initial transaction, provided this does not entail costs for the Customer as a consequence of the refund; however, pursuant to Art. 56(3) of Legislative Decree no. 21/2014, FANATICS ITALY may withhold the refund until it has received the goods or until the Customer has provided proof of having shipped the goods back, whichever occurs first.
8.7. The right of withdrawal may be exercised only by natural persons acting for purposes unrelated to any business, commercial, craft or professional activity (consumers). Therefore, among others, resellers and companies are excluded from the right of withdrawal.
8.8. The right of withdrawal is likewise excluded, pursuant to Art. 59 of Legislative Decree no. 21/2014, in the case of customized goods (see Art. 2.6 above), as well as sealed goods that are not suitable to be returned for reasons of hygiene or health protection and that have been opened after delivery.
8.9. No refunds are made for goods customized at the Customer’s express request (e.g., products customized with player or personal names and/or numbers, patches, initials, except for faulty or damaged products); for underwear, swimwear and face masks; for match jerseys following a change of squad number or transfer of the player. Discounted products (Outlet section, special promotions) are non-refundable.
Art. 9 – CUSTOMER RIGHTS IN CASE OF NON-CONFORMING PRODUCTS (restored in Lazio’s form)
9.1. If the Customer, being a consumer, detects a lack of conformity of the product, the Customer may request a refund. Termination/refund is excluded in cases of minor non-conformities.
9.2. Following the report, FANATICS ITALY will, within a reasonable time, arrange collection of the product at the Customer’s address and, after verifying the defect, proceed with a partial or full refund of the price; in any case FANATICS ITALY may propose alternative remedies available, such as, by way of example, issuing a voucher equal to the amount paid, to be used later by contacting Customer Service; if the Customer accepts, FANATICS ITALY will implement the specific remedial solution proposed.
Art. 10 – PRIVACY
10.1. The data provided by the Customer and necessary for performance of the Contract are processed in compliance with Legislative Decree 196/2003 on Personal Data Protection. For further information the Customer may consult the Privacy section of the Site.
Art. 11 – COMMUNICATIONS
11.1. All communications between the parties must be made in writing and sent to the address of the other party indicated, for FANATICS ITALY, in these terms, and, for the Customer, in the Order submitted.
11.2. Communications sent to the other party’s email address, as identified above, are also validly made in writing.
Art. 12 – APPLICABLE LAW AND JURISDICTION
12.1. By entering into the Contract pursuant to Art. 2 above, the parties agree that it is governed by Italian law and subject to Italian jurisdiction, and that application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
12.2. For any dispute concerning the validity, performance or interpretation of the Contract and the related effects, jurisdiction shall lie with: a) the court of the Customer’s place of residence or domicile, if the Customer is a consumer and is resident or domiciled in Italy; b)exclusively the Court of Milan in all other cases.
12.3. The Customer may also optionally resort to the mediation procedures under Legislative Decree 28/2010 for the resolution of disputes arising in the interpretation and performance of these conditions of sale by accessing the following site: https://webgate.ec.europa.eu/odr.
